The standard pass mark and annual pass rate answer different questions. The 55% standard pass mark is the published assessment threshold. The 56.12% 2025 pass rate is the proportion of candidates who passed during that year. A pass rate close to half is a warning not to treat J02 as an easy credit.

Know the legal relationship between settlor, trustees and beneficiaries. Be able to explain why a trust may be used, its limitations and how it differs from an ordinary contract.
2. Creating Trusts
Study the methods and rules of creation, the main trust types and the property that can be held. Build comparison grids rather than isolated definitions—for example, bare versus discretionary trusts and revocable versus irrevocable arrangements where relevant.
3. Investing and Administering Trust Assets
This includes trustee duties, investment powers, variation, charitable trusts, offshore trusts and practical administration. When revising a duty, connect it to the decision or risk it is intended to govern.
4. Substituted Decision Making
Distinguish general, lasting and enduring powers of attorney, then connect them to the Court of Protection, Office of the Public Guardian and Mental Capacity Act framework.
5. Wills and Intestacy
Candidates must understand valid Wills, intestacy, post-death variations, revocation and challenges, and the responsibilities of executors and administrators.
6. Bankruptcy
Know the parties in the bankruptcy process and how bankruptcy may interact with trust property and beneficiaries.
7. Taxation of Trusts
This is a major integration area. You must separate the liabilities and responsibilities of settlors, trustees, beneficiaries and personal representatives across Income Tax, Capital Gains Tax and Inheritance Tax.
8. Investments Placed in Trust
Understand why life policies, pensions and other investments may be placed in trust, the trustees’ responsibilities and the resulting tax implications.

The final outcome requires application: selecting and explaining a suitable arrangement for a client’s objectives and recognising events that should trigger a review.
Which J02 Areas Commonly Cost Candidates Marks?
The February 2026 examiner comments are useful because they identify the difference between broad familiarity and exam-ready detail.
Candidates generally handled familiar areas such as trustee duties, bare versus discretionary trusts, intestacy and interest-in-possession trust income. Weaker performance appeared in:
- fully secret trusts and the conditions required for enforcement;
- vulnerable-person trust tax treatment and election procedure;
- the post-April 2025 treatment of excluded-property trusts;
- estate Income Tax calculations;
- back-to-back arrangements;
- distinguishing interest-in-possession taxation from discretionary-trust treatment; and
- including enough specific detail to earn every available mark.
Do not turn that list into a prediction of the next paper. Its value is diagnostic: it shows that low-frequency topics, recent legislative changes and similar-looking tax treatments expose shallow revision.
How Should You Answer J02 Short-Answer Questions?
Use a mark-led process.
- Circle the command word. State, describe, explain, calculate and compare require different depths.
- Read the mark allocation. Six marks normally require more than two developed ideas.
- Plan distinct points. Avoid rewriting one point in three ways.
- Use short sentences or note form. The official guide recommends concise answers provided they contain sufficient detail.
- Apply the scenario. If the question gives a client, trust type, date or objective, use it.
- Show every calculation stage. Label allowances, rates and subtotals so the method can earn marks even if the final number is wrong.
- Stop when the time budget expires. Flag the question and return later.
The raw time budget is approximately 55 seconds per mark: 120 minutes divided by 130 marks. An eight-mark question therefore deserves roughly seven minutes, including planning and checking.
